What should you know about copyright to ... - My Legal Briefcase

As producers of creative work, artists, writers and designers alike, often do not consider the importance of business transactions. Often too preoccupied with the idea of producing a piece of expression, or designing a solution, creators ?fail to follow the right steps in order to ensure that they are fairly compensated fairly for what their work is really worth.

If the number seems fair, there is a big chance that you are signing away a lot more than you are willing to. You should read the contract actively, and look up the words that you don?t understand.

Here are some basic rights that you should consider when selling the copyright to your work:

What is copyright?

Copyright refers to the exclusive right to publish, reproduce and sell a ?work.

Who owns copyright?

Generally, copyright subsists in the creator of the original work; however, copyright in a work can be sold or transferred to others under a variety of conditions. These conditions can vary based on usage, medium, temporality, etc.

Here are some rights that you should consider when signing a contract:

First Rights: The right to be the first to publish a work on a one-time-basis only. Any usage beyond this will be considered infringement of copyright.

Second Rights: The right to re-use an image that has been originally used elsewhere.

Non-exclusive Rights: When the artist as well as the client have the right to both reproduce and sell the image to third parties. This typically creates an unfavourable situation for both parties since an accessible piece of artwork loses its value relatively quickly.

Sublicensing Rights: Refers to a party, other than the creator of the work, owning the right to sell the copyright of an image to any third party. This is a situation one would want to avoid.

All Rights or a Buyout: Refers to the purchase of all rights of usage, while the artist maintains the authorship of the work. This is a situation that can work quite well for the artist if the compensation is fair.

Moral Rights: Refers to the rights that an author can retain which protect the work from being altered without the author?s permission. This right is meant to protect the integrity of the original piece of work. Moral rights can also assure that the client must obtain the creator?s consent in order to modify or update the work.

Fair Use: The right to reproduce a work of art for a very limited and specific purpose without requiring the consent of the copyright owner. An example of this would be the use of a small portion of a book for educational purposes.

Right of Celebrity: The right to use an image of a celebrity for a newsworthy purpose. One may not simply reproduce a celebrity?s image for profit without running the risk of being the target of a lawsuit.?

KOMPAS.com - Microsoft telah mengumumkan keberadaan sistem operasi smartphone terbarunya, Windows Phone 8. Pada kesempatan itu, Microsoft melontarkan sebuah kabar yang kurang menyenangkan untuk pengguna Windows Phone versi 7, termasuk Nokia Lumia tercanggih saat ini, Lumia 900.

Alasannya, smartphone berbasis Windows Phone 7 tak akan diberi opsi upgrade ke Windows Phone 8. Mengapa demikian?

Nah, di Windows Phone 8, Microsoft memutuskan untuk tak lagi menggunakan kernel Windows CE. Windows Phone 8 akhirnya menggunakan kernel Windows NT, sebuah kernel yang juga digunakan di sistem operasi Windows 8 untuk komputer dan tablet.

Inilah sebabnya mengapa smartphone yang sebelumnya menggunakan Windows Phone 7, tidak dapat menjalankan WIndows Phone 8.

"Cara sederhana untuk menganalogikannya adalah, sebelumnya Anda punya ponsel yang mampu menjalankan program, tapi sekarang Anda punya komputer yang dapat melakukan panggilan telepon," jelas Sullivan, seperti dikutip dari Mashable.

Ia menambahkan, ada banyak keuntungan dengan berbagi kernel yang sama. Microsoft dapat mewarisi arsitektur sistem operasi yang tentu sangat berguna untuk pengguna, mitra pembuat hardware, dan para pengembang aplikasi.

Dengan kesamaan kernel ini, diharapkan semua produk Windows dapat berbagi driver perangkat yang sama, sistem file, networking stack (yang kompatibel dengan IPv6), media software, dan keamanan.

Perubahan besar lain yang terjadi di Windows Phone 8, sistem operasi ini didesain agar dapat menerima spesifikasi hardware yang lebih tinggi dari sebelumnya. Ia menerima penggunaan prosesor multi-core, mendukung resolusi layar tinggi dengan tiga macam teknologi layar, mendukung Near Field Communication (NFC), dan bisa menambah memori eksternal MicroSD,

"Semua kebutuhan dan pekerjaan dari smartphone bisa kita dapatkan dari arsitektur ini, dan tentu saja bermanfaat," kata Sullivan.

Kesamaan kernel sistem operasi komputer dan sistem operasi mobile juga dilakukan oleh Apple, di mana Mac OS X dan iOS menggunakan kernel XNU, singkatan dari X is Not Unix.

USADA moves Armstrong case to arbitration panel

(AP) ? The U.S. Anti-Doping Agency says its review board has made a unanimous recommendation to file formal doping charges against Lance Armstrong.

That will move the case to an arbitration hearing if Armstrong chooses to challenge, as he has indicated he would.

USADA confirmed the board's recommendation Friday after one of its members, Clark Griffith, told The Associated Press he "can't wait" to see what the arbitration panel thinks of the evidence.

USADA says it has evidence Armstrong was taking performance-enhancing drugs while winning the Tour de France from 1999-2005. Armstrong says he is innocent.

People carrying guitars on the street have been a rare sight in Cambodia over the past 10 years.

But now, as the Kingdom?s young population continues to grow creatively, musical-instrument shops are popping up around the capital, with more people interested in learning to play, especially teenagers.

Since its founding a year ago in Phnom Penh?s Boeung Keng Kang I neighbourhood, The Music Arts School, an NGO aimed at promoting arts education, has received as many as 170 students, 70 to 80 per cent of whom have been Cambodians.

Students range from age four to adults, but the majority are between 15 and 16.

?In the past 10 or 20 years, people in the capital didn?t want their children to study music,? says Keth Songva, 28, the director of the Music Arts School. ?I think only a few parents still think like that, but most of them see music as a way to make their children smarter. So they send their children to learn at least one musical instrument.?

The school trains students in both traditional Cambodian and Western instruments, but Songva says students seem to prefer Western instruments to traditional ones.

Guitar is the top preference, followed by piano. The third-favourite musical instrument is the violin, he says.

Although the school?s mission is to make music education accessible, the price of nurturing a nascent talent may seem high to the average Cambodian.

Guitar lessons are US$40 a month for four classes, while piano is $30 and violin $40. Traditional Cambodian instrument classes are slightly cheaper: $24 for a month of kem, Khmer drum or tro.

?Most parents who send their children to music school are upper-class. For lower-class people, this fee will be high for them,? Keth Songva says. ?Music schools have just begun to boom in the past few years, so we really lack music teachers. That?s why the fee is still high.?

For this reason, the school offers scholarships to about 20 per cent of its students who are in financial need.

Men Sonita, 16, spends her time outside of her high school, Phanhasastra International School, learning to play the guitar.

She chose the guitar because it?s more popular than other instruments. She can also carry it easily and play it with or without electricity.

?The guitar fits very well with my favourite Cambodian songs from the 1960s such as Arab Piya, Monkey Dance Monkey and Oh Annie,? Sonita says, referring to the so-called golden age of Cambodian rock and roll.

Sonita?s mother, Nhim Pheakdey, says her daughter had insisted on attending music classes since she was very young.

When Sonita was a bit older, Pheakdey bought her an electronic keyboard and hired a music tutor to teach her at home.

For a short period, Sonita could also play the piano.

?It was her idea to attend music school. It wasn?t our idea. We got her piano lessons, and saw she improved. Once I heard from my foreign friends that children who study music are smarter, we got her the guitar class,? Pheakdey says.

She notes that high schools in Cambodia don?t really have any extra-curricular activities such as sports, so she hopes the music lessons will fill her daughter?s free time and help her do something productive rather than getting into trouble.

To celebrate its first anniversary, the Music Arts School will host a student performance night on July 11.

Google+ PlatformGoogle+ is obviously a major focus for Google these days, but until now, the company hasn't really focused on extending the Google platform beyond its own services and its +1 buttons. Now, however, the company is extending the Google+ platform to mobile with the upcoming release of its Google+ SDKs for iOS and Android. This new platform will allow developers to use Google+ sign-in buttons, sharing widgets, ?and the Google+ history API it quietly launched yesterday. Developers will also be able to pull in public Google+ content through the existing (but limited) Google+ API. In addition to these SDKs, these features are also now available as mobile web optimized social plugins.

Chiseled 'Magic Mike' hunk shows off stripper moves

Joe Manganiello, best known for his role as a werewolf in the HBO series "True Blood," appears in the upcoming movie "Magic Mike," playing a stripper named Big Dick Ritchie.?

He gave a sneak peek of a few quick stripper moves as he entered the studio, and Kathie Lee and Hoda were left wanting. ?That?s it?? KLG asked. ?There has to be more,? Hoda said.?

Poll: One-quarter uncommitted in White House race

WASHINGTON (AP) ? They shrug at President Barack Obama and Republican challenger Mitt Romney. They're in no hurry to decide which one to support in the White House race. And they'll have a big say in determining who wins the White House.

One-quarter of U.S. voters are persuadable, according to an Associated Press-GfK poll, and both Obama and Romney will spend the next four months trying to convince these fickle, hard-to-reach individuals that only he has what it takes to fix an ailing nation.

It's a delicate task. These voters also hate pandering.

"I don't believe in nothing they say," says Carol Barber of Iceland, Ky., among the 27 percent of the electorate that hasn't determined whom to back or that doesn't have a strong preference about a candidate.

Like many uncommitted voters, the 66-year-old Barber isn't really paying attention to politics these days. She's largely focused on her husband, who just had a liver transplant, and the fact that she had to refinance her home to pay much of his health bill. "I just can't concentrate on it now," she says before adding, "If there were somebody running who knows what it's like to struggle, that would be different."

John Robinson, a 49-year-old general contractor from Santa Cruz, Calif., is paying a bit more attention, but is just as turned off by both candidates.

"I'm just bitter about everybody. They just keep talking and wavering," said Robinson, a conservative who backed the GOP nominee in 2008, Arizona Sen. John McCain, but is undecided between Obama and Romney. "There's nothing I can really say that's appealing about either one of them."

To be sure, many of the 1-in-4 voters who today say they are uncommitted will settle on a candidate by Election Day, Nov. 6.

Until then, Obama and Romney will spend huge amounts of time and money trying to win their votes, especially in the most competitive states that tend to swing between Republicans and Democrats each presidential election. Obama and Romney face the same hurdle, winning over wavering voters without alienating core supporters they need to canvass neighborhoods and staff telephone banks this fall to help make sure their backers actually vote.

"It presents an interesting challenge to the campaigns," said Steve McMahon, a founding partner in Purple Strategies, a bipartisan crisis management firm. "Moving to the middle means winning these voters, but it also means creating problems with your base."

Obama has sought to straddle both the left and the middle by announcing policies that expand access to contraception and allow immigrants brought illegally to the United States as children to be exempted from deportation and granted work permits if they applied.

Both issues are popular with his core supporters and centrist voters. The president also is promoting a list of what he says are bipartisan measures that would help homeowners, veterans, teachers and police officers, and he accuses Republicans of causing gridlock by refusing to act on them. It's a pitch intended for independent-minded voters frustrated by inaction in Washington.

Romney has broadened his tea party-infused message from the GOP primary and softened his tone as he looks to attract voters from across the political spectrum.

He abandoned the harsh immigration rhetoric on Thursday when he pledged to address illegal immigration "in a civil but resolute manner" while outlining plans to overhaul the green card system for immigrants with families and end immigration caps for their spouses and minor children. In doing so, he risked inflaming conservatives who make up the base of the Republican Party.

Overall, the poll found that among registered voters, 47 percent say they will vote for the president and 44 percent for Romney, a difference that is not statistically significant.

Those totals include soft support, though, meaning people who lean toward a candidate as well as those who said they could change their minds before November. The poll showed that these persuadable voters are equally apt to lean toward Obama, Romney, or neither, with about one-third of them in each camp.

The survey also showed that these voters are more likely than others to say they distrust both Romney and Obama on the major issues. They are far more likely to think the outcome of the election won't make a big difference on the economy, unemployment, the federal budget deficit or health care.

Party politics and wedge issues have dubious weight with this group. The poll found more independents fall into this category than partisans. The partisans who are persuadable are more likely to be in the ideological middle than either liberal Democrats or conservative Republicans. Seventeen percent of persuadables say they consider themselves supporters of the tea party.

The poll also found that demographically, they are more likely to be members of Generation X (between the ages of 30 and 49) than other registered voters. Many, 71 percent, have not graduated college. They are a bit more likely to have lower incomes than all registered voters. Fifty-two percent of persuadables have incomes below $50,000, compared with 44 percent of all voters.

On other characteristics ? gender, religious preference and race ? they're split similarly to other registered voters.

The Associated Press-GfK Poll was conducted June 14-18, 2012 by GfK Roper Public Affairs and Corporate Communications. It involved landline and cellphone interviews with 1,007 adults nationwide, including 878 registered voters and 228 persuadable voters. Results for the full sample have a margin of sampling error of plus or minus 4.0 percentage points. For registered voters it is 4.2 points and for persuadable voters it's plus or minus 8.3 points.

Juror: Sandusky accusers' credibility boosted case

BELLEFONTE, Pa. (AP) ? The credibility of the accusers who testified at the trial of Jerry Sandusky solidified the case against him, a juror said Saturday, a day after the retired Penn State coach once viewed as the successor to Joe Paterno was found guilty on 45 counts of child sex abuse.

"It's hard to judge character on the stand because you don't know these kids," Joshua Harper told NBC's "Today." ''But most were very credible ? I would say all."

"It was very convincing," he added.

After a swift trial and less than two days of deliberations, Sandusky was found guilty Friday. Mandatory minimums mean he will likely die in prison.

Sanduksy's own impassivity as the verdict was read was also a confirmation that the jury's decision was the right one, Harper said.

"I looked at him during the reading of the verdict and just the look on his face. No real emotion," he said.

Sandusky appeared to be accepting his fate, Harper said, "because he knew it was true."

The verdict is not the end of the scandal that took down Paterno and deeply shook the state's most prominent university. It will play out for years in courtrooms and through a set of ongoing investigations.

But the trial did present one piece of finality: Sandusky was taken away in handcuffs to the county jail. Sentencing will be in about three months.

Sandusky is one 272 inmates at the Centre County Correctional Facility and was kept under watch overnight. The jail is just seven miles from the Penn State campus.

Like other inmates there, he was allowed to bring a small number of items in with him. The options include six pairs of white underwear, white socks and white undershirts, prescription glasses or contact lenses, a wedding band, religious prayer book, no more than 10 personal photographs and 10 letters and no more than 4 inches of legal documents or materials.

Sandusky will be allowed to shower daily, and can get visits from his family, friends and lawyers, too.

The jail did not say whether anyone had come to see him Saturday. At his home, his wife and three of their adopted children remained inside after returning there Friday night. The windows blinds and curtains were drawn.

"One of the recurring themes in this case was, 'Who would believe a kid?'" Attorney General Linda Kelly said. "The answer is, we in Bellefonte, Pa., would believe a kid."

Sandusky, a retired defensive coach, showed little emotion as the verdict was read, giving his wife, Dottie, and family members a half-wave as the county sheriff led him away.

There were only three acquittals among the charges related to 10 victims, eight of whom took the stand to describe fondling, forced oral sex and anal rape. Many of the accusers testified that they had told no one of the abuse that dated as far back as the mid-1990s ? not parents, not girlfriends and not police.

The accuser known in court papers as Victim 6, whose mother alerted authorities in 1998 after Sandusky took her son into a shower, broke down in tears upon hearing the verdicts in the courtroom. Afterward, a prosecutor embraced him and said, "Did I ever lie to you?"

The man, now 25, testified that Sandusky called himself the "tickle monster" in a shower assault. He declined to comment to a reporter afterward. His mother said: "Nobody wins. We've all lost."

One of the three counts for which Sandusky was acquitted concerned Victim 6, an indecent assault charge. The man testified that Sandusky had given him a bear hug in the shower but at one point he just "blacked out."

The other acquittals were an indecent assault charge related to Victim 5, who said Sandusky fondled him in the shower, and an involuntary deviate sexual intercourse charge regarding Victim 2, the boy graduate assistant Mike McQueary saw being attacked in a campus shower.

That charge resulted in an acquittal because McQueary did not see penetration, Harper said. But, Harper said, McQueary made it apparent he saw something "that was wrong and extremely sexual."

"We did not have the evidence that that very first charge happened," Harper said. "... And we were in agreement amongst all the jurors that because of that, we could not convict him of that first count."

Almost immediately after the judge adjourned, loud cheers could be heard from a couple hundred people gathered outside the courthouse as word quickly spread that Sandusky had been convicted. The crowd included victim advocates and local residents with their kids. Many held up their smartphones to take pictures as people filtered out of the building.

As Sandusky was placed in the cruiser to be taken to jail, someone yelled at him to "rot in hell!" Others hurled insults and he shook his head no in response.

Defense attorney Joe Amendola was interrupted by cheers from the crowd on the courthouse steps when he said, "The sentence that Jerry will receive will be a life sentence."

In addition to the eight who testified, there were two yet-unidentified victims for whom prosecutors relied on testimony from a university janitor and McQueary, whose account of a sexual encounter between Sandusky and a boy of about 10 years old ultimately led to the Paterno's dismissal and the university president's ouster.

Sandusky did not take the stand in his own defense.

After the verdict was announced, defense attorney Karl Rominger said it was "a tough case" with a lot of charges and that an appeal was certain. He said the defense team "didn't exactly have a lot of time to prepare."

The ex-coach had repeatedly denied the allegations, and his defense suggested that his accusers had a financial motive to make up stories, years after the fact. His attorneys also painted Sandusky as the victim of overzealous police investigators who coached the alleged victims into giving accusatory statements.

One accuser testified that Sandusky molested him in the locker-room showers and in hotels while trying to ensure his silence with gifts and trips to bowl games. He also said Sandusky had sent him "creepy love letters."

Another spoke of forced oral sex and instances of rape in the basement of Sandusky's home, including abuse that left him bleeding. He said he once tried to scream for help, knowing that Sandusky's wife was upstairs, but figured the basement must be soundproof.

Another, a foster child, said Sandusky warned that he would never see his family again if he ever told anyone what happened.

And just hours after the case went to jurors, lawyers for one of Sandusky's six children, Matt, said he had told authorities that his father abused him.

Matt Sandusky had been prepared to testify on behalf of prosecutors, his lawyers said in a statement. The lawyers said they arranged for Matt Sandusky to meet with law enforcement officials but did not explain why he didn't testify.

"This has been an extremely painful experience for Matt and he has asked us to convey his request that the media respect his privacy," the statement said. It didn't go into details about his allegations.

Defense witnesses, including Dottie Sandusky, described Sandusky's philanthropic work with children over the years, and many spoke in positive terms about his reputation in the community. Prosecutors had portrayed those efforts as an effective means by which Sandusky could camouflage his molestation as he targeted boys who were the same age as participants in The Second Mile, a charity he founded in the 1970s for at-risk youth.

Sandusky's arrest in November led the Penn State trustees to fire Paterno as head coach, saying he exhibited a lack of leadership after fielding a report from McQueary. The scandal also led to the ouster of university President Graham Spanier and criminal charges against two university administrators for failing to properly report suspected child abuse and perjury.

The two administrators, athletic director Tim Curley and now-retired vice president Gary Schultz, are fighting the allegations and await trial.

The family of Paterno, who died exactly five months before Sandusky's conviction, released a statement saying: "Although we understand the task of healing is just beginning, today's verdict is an important milestone. The community owes a measure of gratitude to the jurors for their diligent service. Our thoughts and prayers continue to be with the victims and their families."

In a statement, Penn State praised the accusers who testified and said that it planned to invite the victims of Sandusky's abuse to participate in a private program to address their concerns and compensate them for claims related to the school.

Sandusky had initially faced 52 counts of sex abuse. Prosecutors dropped one count and the judge tossed three others during the trial, on grounds two were unproven, one was brought under a statute that didn't apply and another was duplicative.

Sea-level rise could hit California hard

SACRAMENTO, June 23 (UPI) -- A report on sea-level rise commissioned by the states on the West Coast is especially disturbing for California, scientists there say.

That's partly because scientists at the National Academy of Science's research unit determined sea levels are rising faster south of Cape Mendocino than to the north of it because geological forces to the north are pushing the land up, the San Francisco Chronicle reported. The cape is in Humboldt County and the state's major metropolitan areas are south of it, while Oregon and Washington are north.

In the San Francisco area, where major airports and many towns in the region are already only a few inches above sea level, any significant rise could be devastating, the report said.

Estimates of sea-level rise for Southern and Central California covered a broad range. The report, which was released Friday, said by 2030 the increase could be anywhere from 1.5 inches to a foot, from 4.5 inches to 2 feet by 2050 and from 16 inches to 4.5 feet by the turn of the century. While even the lowest estimates would have a significant impact, increasing the strength of coastal storms and drowning wetlands, the upper ones could make life very difficult.

As an additional problem, scientists said, a major earthquake could cause a sudden local rise in sea level.

The California Department of Water Resources and its counterparts in Oregon and Washington commissioned the report as a planning tool.

Palestinians push Nativity church as Heritage site

PARIS (AP) ? The Church of the Nativity in Bethlehem is becoming the church of contention, with a bid by the Palestinians to use their position as the newest members of the U.N.'s cultural arm to obtain World Heritage status for the iconic Christian site ? and perhaps boost their own campaign for legitimacy.

The effort by the Palestinian Authority, like its overall efforts for global recognition for an independent Palestinian state, is drawing resistance. And it may fail at the World Heritage Committee meeting that starts Sunday.

An experts committee has turned down the emergency bid to quickly confer on the Church of the Nativity, and its pilgrimage route, the status as an endangered World Heritage site, saying the application needs more work. Even custodians of the holy site, the Greek Orthodox, Roman Catholic and Armenian churches are opposed, according to a document obtained by The Associated Press.

The church ? which drew some 2 million visitors last year and parts of which are 1,500 years old ? stands above the grotto that Christians believe was the birthplace of Jesus. The Palestinians' application asks for recognition as a site of "outstanding universal value" urgently in need of attention.

There is concern by the United States and others that the Bethlehem holy site and the integrity of the World Heritage process risk falling victim to the politics that for decades have torn the region asunder, with the Palestinians using their foothold in the U.N. system to grab symbolic recognition of their elusive bid for statehood in a long-disputed land.

The World Heritage candidacy of the Church of the Nativity and the pilgrimage route is one way for the Palestinians to prove they are responsible stewards of the site which draws tourists the world over. Above all, it is part of a broader attempt by Palestinian President Mahmoud Abbas to seek international recognition for a state of Palestine after its controversial backdoor entry into the U.N. system.

Negotiations with Israel on the terms of a Palestinian state have been frozen since 2008, mainly because Abbas and Israel's hardline prime minister, Benjamin Netanyahu, have failed to reach enough common ground for meaningful talks.

Meantime, Abbas has tried to create new leverage, including with a quest for U.N. membership for a state of Palestine in the West Bank, Gaza and east Jerusalem, the territories Israel occupied in 1967. The U.N. bid has been stalled for months, but Abbas hopes to garner recognition for Palestine wherever possible, including with a nod from UNESCO for Bethlehem.

Angry at Palestinian membership in UNESCO, the United States pulled its $80 million in annual dues ? 22 percent of the overall budget ? from the Paris-based organization after the October vote that made the Palestinians the 195th member.

Bucking the bad feedback, the Palestinians refused to follow UNESCO custom and withdraw the candidacy ? as the French did with their emergency bid for the Chauvet cave, with its hundreds of prehistoric drawings, when it got a negative recommendation from the experts.

The Palestinians now risk losing face at the World Heritage Committee meeting from Sunday until July 6 in Saint Petersburg, Russia, when 33 sites from around the world will be considered for the coveted World Heritage status.

A surprise thumbs up could feed rancor and rivalries in a volatile region, within the church itself and perhaps at the U.N. Educational, Scientific and Cultural Organization.

Already, the Palestinian ambassador to UNESCO, Elias Sanbar, has denounced a "persistent campaign of rumors" at the organization.

Protecting the cultures of the world is among UNESCO's core missions and there is little doubt the Church of the Nativity ? with a longstanding problem of leaks from the roof ? is in need of repair. A program administered by the Palestinians is already in progress.

Located in the Israeli-controlled West Bank, it is managed by three churches, each jealous of its role as custodian of the site, defined under an agreement dating back to the Ottoman Empire.

With a big measure of diplomacy, the leaders of the Greek Orthodox, Catholic and Armenian churches rebuffed the Palestinian proposal, politely reserving judgment on its reasons.

"In our opinion, we do not think it opportune to deal with this request that the Basilica and its entire complex be included in the list of World Heritage sites, due to different considerations," read a letter to Palestinian Authority Mahmoud Abbas signed by the three leaders. A copy of the letter was obtained by The Associated Press.

Among other things, a World Heritage designation raises fears that the delicate arrangement of custodianship might be disturbed. Fights among priests using broomsticks have been known to break out in the past over a perception that boundaries are being overstepped.

"When it comes to the Church of the Nativity, no one can interfere," said Yousef Daher of the World Council of Churches in Jerusalem. "They (the Palestinian Authority) figured it wrong." He called the Palestinian bid a "surprising request."

"A church is a church, it shouldn't become a world heritage. It's a sacred place and its ownership is not for anyone," Daher said.

The Palestinian emergency application cites lack of regular restoration on the church due to the political situation since 1967 when Israel occupied the territories and difficulties procuring equipment because of lack of free movement imposed by Israeli forces.

Though Israel captured the West Bank, it turned much of Bethlehem over to the Palestinian Authority in the 1990s.

The U.S. State Department did not hide its disapproval of the Palestinians' emergency bid.

"We are disappointed by the Palestinians' intention to push through an emergency inscription against the recommendation of UNESCO's own experts and without thoroughly consulting all stakeholders," a statement said. It made clear that Washington's objection stems from the rush job that an emergency candidacy implies and which prevents a full review including by those with a stake in the outcome.

"We hope the Committee will act responsibly as good stewards of the World Heritage Convention, rather than allowing yet another U.N. forum to become a victim of politicization," the U.S. statement said. "The site is sacred to all Christians."

An experts report, conducted for UNESCO by the Rome-based International Council on Monuments and Sites, which reviews all applications, concluded that the Palestinians failed to show that damage or dangers to the Church of the Nativity "make its condition an emergency that needs to be addressed ... for immediate action necessary for the survival of the property."

It suggests the application be resubmitted under normal procedures with fuller detail. That takes about 18 months, meaning it could be re-nominated in 2014.

"Palestinians are continuing with their bid, and they are still hopeful and optimistic that they will succeed," said Palestinian government spokesman Ghassan Khatib. He declined to elaborate.

The Palestinian delegation to UNESCO refused any comment until after the Saint Petersburg meeting. However, a letter circulating among delegations suggested a plot was afoot.

In a letter, Ambassador Sanbar denounced a campaign of pressure against the bid from "those who do not want to see Palestine exercise its legitimate rights."

The June 11 letter, a copy of which was obtained by The Associated Press, included what is purported to be a statement of support for Palestinian leader Abbas signed in type by the Roman Catholic and Greek Orthodox leaders, noting the Armenian was absent.

That letter "gave some delegations the impression that the churches had changed their opinion and were no longer opposed to the inscription," said one UNESCO official. "Was it designed for that purpose? I don't know."

The official asked not to be identified because of the sensitivity surrounding the Palestinian bid.

Despite fears by some that Palestinian backers on the committee will win the church the emergency designation as an endangered World Heritage site, others say it would be highly unusual for the voting committee to ignore the experts' negative recommendation.

"The committee is a sovereign body. Experts are there to give expert advice that is usually taken on board," said UNESCO spokeswoman Sue Williams.

Win or lose, the Palestinians are looking to putting their mark on other sites under their purview, including historic Bethlehem.

That gets a green light from the custodial churches at the Nativity ? as long as the church itself stays off limits.

Be honest. Deep down, is this what you?re thinking? That as soon as you?re at your ideal weight or in your dream job or driving your fantasy car that you?ll have your happily ever after. That?s what many people think and that?s why this is Barrier #1.

When you put this much pressure on any one goal (thereby putting that much pressure on yourself) then you?re setting yourself up for failure.

A little tweak in your thinking might make all the difference.

Did you know research shows the act of setting and achieving goals leads to greater personal fulfillment and happiness than simply having everything you want at the snap of your fingers? That sense of achievement you get from having a dream, setting a goal, and making it happen is more important to your happiness than simply having what?s at the end of your rainbow. The journey, the getting ?there? will ultimately make you happier than the destination itself. It?s not ?the goal? that makes you happy, it?s the process.

True, authentic deep-down happiness comes from always reaching, always striving to be your very best you. Losing weight, finding a significant other, buying your dream car, or getting that corner office are fabulous stepping stones along your happy path but they aren?t the have-all and the end-all. Your life won?t be ?happily ever after? once you?ve met what you think is your lifelong happiness goal. There is no one particular ?happily ever after? goal for anyone. It?s a beautiful, inspiring continuous circle.

Once you?ve made the connection that a life-time of amazing happiness comes from constantly having new dreams, setting goals, taking action, and making it happen then you?ll really be on your way!

Which leads naturally into the next greatest barrier.

#2- I Have No Idea How To Set A Goal

That?s another huge one. Most of us have never been taught how to actually set a goal that we can meet.

Have you ever set one of these goals?

I?m going to lose 50 pounds. I?m going to start my own business. I?m going to have more fun. I?m going to travel more. I?m going to learn how to cook healthier.

I bet you have your own list of goals that you?ve never been able to meet: Goals that are always niggling in the back of your brain making you feel like a failure because you haven?t met them. It?s all part of the baggage that we?re lugging around on our backs (and in our minds). Goals like these are self-defeating and self-esteem crushing!

Don?t let yourself become a victim. Take charge of your goal-setting and make your dreams your reality!

SMART goals may be your ticket to freedom. Try following this template whenever you set a goal and you?ll up your chances of meeting that goal a thousand-fold.

S ? Specific: Be as specific and detailed as possible. No generic, global phrases. A goal like "I?m going to learn how to say 5 phrases in Italian so that I can get from the airport to my hotel when I visit Sicily" is much more powerful than "I?m going to learn Italian".

M ? Measurable: Having it be measurable (like the 5 phrases in the above example) lets you know when you?ve met it.

A ? Achievable or Attainable: Your goal has to be something that you can realistically meet. Expecting yourself to be fluent in Italian or lose 50 pounds or have the corner office by Christmas are probably not attainable. Learning 5 phrases in Italian, losing 10 pounds, and completing an impressive project at work probably are. Remember, set yourself up for success. This isn?t going to be the only goal you set so it doesn?t have to encompass everything you want in life.

R ? Relevant: Some researchers have the "R" stand for realistic but that?s also met in the "A" criteria. We like the "R" to stand for relevant because your goal has to be important (relevant) to you. Setting a goal to make your husband, your boss, your parents, your kids, your friends, or your doctor happy will be setting you up for anger, frustration, and quitting. You have to want to meet this goal for reasons that are entirely your own.

T ? Time-specific: Having a time limit on when you?ll meet that goal will add just the right amount of pressure to keep you from procrastinating.

Each SMART goal that you set can then be broken down into many short-term goals. This is where the ?action? takes place. Short-term goals tell you exactly how you?re going to get to where you want to be. And your short -term goals can follow the SMART template, as well.

A juror said Jerry Sandusky showed no emotion as the guilty verdict was read, confirming for him and his fellow jurors that they had made the right call in convicting the former Penn State assistant football coach on 45 out of 48 counts of child sexual abuse.

?That was just confirmation,? Harper told NBC?s ?Today? on Saturday. ?I looked at him during the reading of the verdict and just the look on his face, no real emotion. Just kind of accepting, you know, because, it was true.?

Harper said the jury worked through the charges systematically, combing over any inconsistencies in witness testimony and reconciling them. Ultimately, Harper said, there was a corroborating story among all of the victims and jurors ?were on the same page.?

Harper said he and his fellow jurors did not learn that Sandusky?s adopted son had come forward accusing his father of abusing him as well until after they made their decision.

?We heard about it the same time, we had suspected that but we had no evidence of it,? Harper said. ?It just solidified our decision.?

(AP) ? Nail Yakupov is ready to live with the spotlight that comes with being a No. 1 pick.

On the night he was chosen first in the NHL draft, he had to share it when the host Pittsburgh Penguins traded popular forward Jordan Staal to the Carolina Hurricanes.

An hour after the Edmonton Oilers started the draft on Friday night by selecting the dynamic 18-year-old Russian forward with the top overall selection, the Penguins shook up the somewhat ho-hum proceedings by sending Staal to a reunion with his brother Eric in Carolina.

When NHL commissioner Gary Bettman announced the trade, Consol Energy Center shook with the kind of fervor normally reserved for a playoff game and dwarfed the modest applause that accompanied Yakupov to the stage to don an Oilers sweater.

No matter. Yakupov never really bought into the hype anyway. The sooner he can start playing and stop talking, the better.

"I can't wait," Yakupov said after being the first Russian taken with the No. 1 pick since Washington drafted Alex Ovechkin in 2004.

Yakupov respects the two-time MVP but patterns his game after another Russian star, Pavel Bure. In a way, Yakupov already has one leg up on his idol.

The Russian Rocket scored 437 goals during his 12-year career, but he wasn't taken until the sixth round of the 1989 draft.

Yakupov, who spent the last two seasons with the Sarnia Sting of the Ontario Hockey League, didn't have to wait nearly as long to hear his name called. The Oilers, picking No. 1 for the third straight year, practically sprinted to the podium to grab the player they believe is the next piece of a core that includes center Ryan Nugent-Hopkins and winger Taylor Hall, the top picks in the previous two drafts.

"I think it's going to be a great team," Yakupov said.

Yakupov, who scored 31 goals in 42 games last season, is eager for the next step following weeks of speculation.

"It's not over, it's just starting," he said.

Born in the Republic of Tatarstan in Russia, Yakupov has consistently shot down speculation he is going to return to his homeland and play in the Kontinental Hockey League. He stressed repeatedly in the days leading up to the draft that the NHL is "the best league in the world."

While hardly the biggest player on the ice, the 5-foot-11, 185-pound Yakupov has dazzling speed and nimble footwork. He plays with a relentlessness that made him the top player on most draft boards. Yakupov broke Sarnia's rookie scoring record ? held by Steven Stamkos ? in the 2010-11 season when he finished with 49 goals and 101 points.

Yakupov was also a rarity in a top 10 dominated by defense. Other than Sarnia teammate Alex Galchenyuk ? taken third overall by Montreal ? the other eight picks were defensemen.

The Columbus Blue Jackets continued to shore up their blue line by taking Ryan Murray of the Western Hockey League's Everett Silvertips with the second pick. The 6-foot, 198-pound Murray had nine goals and 22 assists in 46 games last season.

The 18-year-old Murray became the youngest player since Paul Kariya in 1993 to play for Team Canada in the world championships this spring, and his ability to make an impact on both ends of the ice won over the rebuilding Blue Jackets.

"We are very happy to have Ryan Murray join our organization," Columbus general manager Scott Howson said. "He solidifies what we believe is a position of strength. His character and two-way play will be very valuable to our hockey club."

The prideful Canadiens, coming off a miserable season, hope Galchenyuk can one day provide a needed spark to a lethargic offense. The talented center missed all but two games of this past season after he tore a knee ligament.

Galchenyuk, born in the United States to Russian parents, is considered a gifted passer. He totaled 31 goals and 52 assists during the 2010-11 season. He already speaks two languages, and joked that he had better start picking up French.

"I think I have classes starting next week," he said with a laugh.

With the top high-flying forwards off the board, teams then went heavy on defense in a draft considered short on offensive star power.

The New York Islanders chose defenseman Griffin Reinhart with the fourth pick, starting a run of seven straight defensemen taken.

Among them was Derrick Pouliot, taken eighth overall. That Pouliot was taken so high wasn't remarkable, it was the team that got the pick to grab him that shook up the night.

The Hurricanes had the eighth selection but things changed quickly when Bettman walked onto the stage and announced a trade the hometown crowd "might want to hear."

Moments later, Pouliot pulled on a black Pittsburgh jersey.

"Yeah, I was a little surprised," Pouliot said.

So was the crowd following a whirlwind 24 hours in which the 23-year-old Staal turned down a contract extension from the Penguins, setting off a series of events that ended with Staal ? who is getting married this weekend with most of his former Penguins teammates expected to attend ? moving on.

"We wanted a deal (with Staal)," Pittsburgh general manager Ray Shero said. "But it was obvious in the last 24 hours that ... this was the right thing to do."

Staal, who helped Pittsburgh to the Stanley Cup title in 2009, will join brother Eric in Carolina.

The Penguins weren't done dealing, sending defenseman Zbynek Michalek to Phoenix for defenseman Harrison Ruopp, goalie Marc Cheverie, and a third-round pick. Michalek played five seasons with the Coyotes before signing a free-agent deal with Pittsburgh in 2010.

Washington ended the run on defensemen, taking center Filip Forsberg with the No. 11 pick. The 17-year-old Forsberg was the youngest player on Team Sweden at the 2012 World Junior championships. Forsberg said he models his game after former NHL star Peter Forsberg, though the two aren't related.

The Buffalo Sabres took center Mikhail Grigorenko, who like Yakupov is from Russia, with the No. 12 selection. The massive 6-foot-3, 200-pound Grigorenko led rookies in the Quebec Major Junior Hockey League in scoring last season, netting 40 goals and adding 45 assists for the Quebec Remparts.

The Staals weren't the only players who made the draft a family affair. The Boston Bruins chose goalie Malcolm Subban with the No. 24 pick. Subban's older brother, P.K., is a forward with the Canadians.

Phoenix drafted forward Henrik Samuelsson at No. 27. Samuelsson's father, Ulf, played 1,080 games in the NHL and won two Stanley Cup titles with Pittsburgh.

The elder Samuelsson received a warm ovation when his face flashed up on the Jumbotron. It likely won't be the same for former NHL Stephane Matteau, whose son Stefan was taken by the New Jersey Devils with the 29th pick.

Stephane Matteau, playing for the New York Rangers, eliminated the Devils and rookie goalie Martin Brodeur with a double-overtime goal in Game 7 of the Eastern Conference finals in 1994.

Now his son will try to help the franchise that is coming off a Stanley Cup finals loss to the Los Angeles Kings earlier this month.
